Unfortunately, the level of uncertainty the above scenario creates rules out the possibility of applying Capital Punishment. Caliph Umar ibn al Khattab (RA) did not tell us to actively look for doubt in a case for nothing.
Allaahu aclam. We don't know the situation in Nigeria from here and we don't know what happened in the party and what evidence shariica courts have against them. All we saw was a short article with a summary of events. I hope that the shariica courts will make the right decision inshaa Allaah.
This applies to married people who have sexual intercourse with others too I believe. Its a question I always forget to ask knowledgable people but in the unlikely event of you getting cought cheating on your wife salahudin four witnesses have to see you with their both eyes (ofcourse only one will do if they are weershe/cawars) on top of the chick with her legs stuck in the air. So yeah uhm my question is what are the chances of that actually happening? I mean four people, its just highly unlickely, i make sure all the doors and windows are locked, if you know what am saying.
Culamaa have different opinions should the punishment against homosexuals be more severe than the adultered or the same, but the majority of them and also some of the most knowledgeable companions of Prophet (scws) were holding the opinion that homosexual should be killed regardless of his status, if he's married or not.
It's very hard to find four witnesses who saw the act and I don't know if there has been any case like that in the history. Most or all of the cases of stoning were because the criminal admitted the deed. If the deed will happen in secret and it will be covered from public and other people it won't corrupt anyone else but the doers, if they don't talk about it to anyone. Everything is for the best of the society. Dirty deed done in secret could destroy the doer's aakhirah but it won't affect anyone else. Doing things publicly or talking about it changes the situation and this person is corrupting the people near him and the society so he should be killed.
Bro don't take this as an explanation. There are many reasons why rules are like they are and some of them are probably never known to humans. This was just a one analogical reasoning. Wallaahu aclam.
Some culamaa also said that if someone commits adultery is recommended for him/her to make tawbah and ask Allah's forgiveness and keep it secret rather than to bring it out to public and have him/herself stoned, eventhough the stoning will be expiation for this sin and this person wouldn't be asked about the deed in yawmal qiyaamah.
Salahuddin.. thanks for that bro, it makes things a bit clearer.
