u can kill them if u catch them performing the act lakiin if they repent, they're safe from the sword

they're committing a big sin while doing the act and must repent, but it does not mean kufr

There's nowhere in the diin where it says khaniisnimo takes u outside of Islam...there's criteria and surprisingly homonimo doesn't meet that criteria :o

This is what I heard from a sheik, he said that it says a khaniis will never enter heaven. All Muslims will eventually enter heaven so by saying a khaniis will never enter it means they are not a Muslim.

But what u are saying does make sense.

The one who claims something as in when someone has left islam the right of proof is on him..

exactly, even though it's a disgusting act and we wish it took them out of the diin, it's not our diin to make the rules up as we go along...we have to take Islam as it is....also, Alchemist is right, the burden of proof is upon the one who says something takes u out of Islam

People have to differeniate between belief and action..

For example if someone says alcohol is xalal but does not drink that person has left islam..

If someone drinks alcohol but knows is a sin and feels sad about it than he has sinned..

If a homosexual believes is xalal than he left islam but he believes is a sin than his commiting a major sin but his not a kafir.

Just like a killer he should be excuted, not everyone that islam gives the death penality is a kafir..

Like the one who commits zina while married is stoned to death but his still muslim..

the Sheikhs that were saying it doesn't take u out of the diin used Qowmul Lut as an example....most people think they were destroyed because of khaniisnimo lakiin the reason they were destroyed is cuz they were the most corrupt society...they used to rob people on the highways and farahay ka baxeen....khaniisnimo was only 1 of the reasons why they were destroyed

You also need 4 witnesses to do the punishment for homos, adultery, fornication

If you don't have witnesses, you cannot do the punishment. It is made so people will know their sins and it is between them and Allah
