Lilongwe, Malawi (CNS) - Madonna's bid to adopt a Malawian girl has been rejected. In an unexpected ruling of a Lilongwe judge, the pop superstar has been left unsuccessful in her interim adoption application.
The 50-year-old music icon filed a petition to adopt 4-year-old orphan girl Chifundo James, whose first name translates to Mercy in Chichewa, Malawi's national language. Mercy's mother died days after she was born.
Potential adoptive parents are required to reside in the nation from 18 to 24 months. Madonna resides in New York.
Judge Esmie Chondo has been quoted by the Telegraph as saying, "I must decline to grant the application to Madonna. By removing the very safeguard that is supposed to protect our children, the courts by their pronouncements could actually facilitate trafficking of children by some unscrupulous individuals who would take advantage of the weakness of the laws of the land."
"I must confess that there is a gripping temptation to throw caution to the wind and grant an adoption in the hope that there will be a difference in the life of just one child. However, it should be borne in mind that inter-country adoptions may not be and are not the only solution."
An interim adoption, the first stage of the process, would have allowed Madonna to take the girl out of the country.
There has been no word on whether the singer would appeal the decision.
It must have been a blow to Madonna, who reportedly even planned a welcome party for Mercy while awaiting the judge's decision. A source at Kumbali Lodge, where she is staying, told People.com that Madonna "kept wringing her hands" when her lawyer broke the bad news.
