What are the best contract enforcement guarantees in Somalia ? I am looking to partner with some people in a land far away from my tribal bastion and need to know what are best contract enforcement. Ordinarily, if it was in my regional sphere, I would rely on my kin to make it right by any means necessary. Nor do my potential partners have any assets of value that I can seize if they try to screw me over.

So what are tools that can be used to enforce contracts ? US Law will not apply in Somalia and hard to enforce there. THe only practical solutions I can think of is going to a Islamic scholar to draft an agreement and taking an oath. Or to build some mechanisms that will make me indispensable to the operations lest my partners' conspire with their kinsfolk.

Any ideas folks ?

Contract enforcements and intellectual property rights are alien concepts to the somalis. MPs and government ministers take the oath of office by using the holy Quran and non of them gives a **** afterwards.

Weak states have weak institutions.

You have to deal with reasonable and trustworthy people who's morals and ethics are vouched for by people that can be trusted. Any transactions or contracts between you and others witnessed by kin/friends/relatives who have influence and can hold both of you accountable should there be any renegation of contract. There is no guarantee of contract enforcement in Somalia.
