Judge Hyper come In

Postby Sumubaridi » Tue Nov 24, 2015 7:24 am

Am I right in this regard in Shariica?

In Islam, you must have lost something tangible or must have suffered bodily harm. I was arrested because I was a Muslim does not justify financial compensation Soomaaha?. You were arrested and released without physical harm and without anything taken away from you. You did not loose anything financially.

I am not judge or a lawyer, but I have got a question for you Sumu. What exactly constitutes 'bodily harm'? if you were unlawfully and maliciously arrested and as a direct result suffered a mental distress, would not that be considered bodily harm of a sort? And if so, would not that entitled you for some form of financial compensation?

i am not a sheikh/mofti but i read for sheikhs and learn my own times now. the new scholars such; almowsoo3ah al fiqiyah islamia, talk about what we call " al tharar al ma3nzwi/ الضرر الأدبي، أو المعنوي. best i read says; we have nothing to say about it. it's very rare people to say "we have nothing to say about it" so i ran with it.

فقد ذكر أصحاب الموسوعة الفقهية أنه لا يوجد لهم كلام عليه، فقد جاء في الموسوعة (13-40) تحت عنوان "التعويض عن الأضرار المعنوية":.

i guess you use law of the land and the agreement between you and the other part. the kid's family milking what happened and it was a huge break for them. i heard people here started to not excited abouty them and the family not liking it.
